1. Draft status and SMS non-scope

This policy is a practical operating draft and must be reviewed by a qualified Canadian lawyer before launch. Vibeler's current product scope includes SendGrid-backed newsletters and transactional email, not SMS messaging. This policy therefore addresses commercial electronic messages and newsletters instead of copying an SMS policy.

2. CASL baseline

Canada's anti-spam legislation generally requires consent before sending commercial electronic messages, truthful sender information, valid contact information, and an unsubscribe mechanism. The sender should be able to prove consent where required.

  • Consent may be express or implied only where CASL allows it.
  • Commercial messages must identify the sender and anyone on whose behalf the message is sent.
  • Messages must include a current mailing address and another valid contact method where required.
  • Unsubscribe must be clear, readily performed, free to the recipient, and actioned within the required time period.
  • Commercial content must not be false or misleading.

3. Vibeler newsletter mechanics

Vibeler newsletter sends are article-backed. The platform stores newsletter task status, recipient delivery rows, provider message metadata, unsubscribe tokens, and delivery outcomes. Newsletter emails include recipient-specific unsubscribe links and List-Unsubscribe headers where implemented.

Vibeler may block, throttle, suppress, or refuse newsletter sending for consent, deliverability, spam, abuse, payment, legal, security, or provider-requirement reasons.

4. Creator responsibilities

  • Collect and document valid consent before sending creator commercial messages.
  • Use Vibeler newsletter tools only for recipients who agreed to receive that creator's communications or where another lawful CASL basis applies.
  • Do not import, buy, scrape, harvest, or use email lists without a lawful basis.
  • Honor unsubscribe, suppression, bounce, spam complaint, and preference signals.
  • Keep subject lines, sender identity, product claims, event claims, pricing, discounts, and urgency claims truthful.

5. Transactional and service messages

Some account, billing, security, confirmation, legal, purchase, subscription, and support messages may be transactional or otherwise treated differently from marketing messages under applicable law. Vibeler still aims to keep these messages accurate, limited, and identifiable.
